Making a contract with Nipper Skipper Ltd
Your order constitutes an offer to Nipper Skipper Ltd to buy goods. We will send you an email to confirm that we have received your order. All orders are subject to acceptance by Nipper Skipper Ltd, once we have checked the price and availability of the goods. Such acceptance will be by way of email confirming payment has been received for the goods (the purchase confirmation). The contract between you and Nipper Skipper Ltd will only be formed when you are sent the purchase confirmation.
In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this. You will not receive an email confirming acceptance of your order, and there will be no contract between us if this is the case.
Goods supplied are not for resale.
Accuracy of content
We have tried hard to ensure that all prices and descriptions are accurate on the website. The price of any products will be as quoted on our site, except in cases of obvious error. We have made every effort to ensure that colour reproduction of images and product descriptions are as accurate as possible, but please note that slight variations may occur.
Orders will only be accepted when there are no material errors in the description of the goods and no pricing errors on the website.
Acknowledgement and acceptance of your order
You will need to provide us with your e-mail address and we will notify you by e-mail as soon as possible to confirm receipt of your order and to confirm details. An acceptance of your order will take place on despatch of the good(s) ordered.

You are able to correct errors on your order up to the point on which you click on “submit” during the ordering process
Price and payment
The price of any products will be as quoted on our site, except in cases of obvious error. It is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. We will normally verify prices as part of our despatch procedure. Where a product’s correct price is less than our stated price, we will charge the lower amount when despatching the product to you. If a product’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before despatch, or reject your order and notify you of such rejection.
We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you an Order Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as mispriced.
Prices include VAT at the appropriate rate, where applicable. Please note that children’s clothing and lifejackets are charged at 0% VAT. However buoyancy aids, safety equipment and some accessories are charged at 20% VAT. Please see www.hmrc.gov.uk for specific details.
Payment is to be made in pounds sterling only. If you are purchasing from outside the United Kingdom you will be charged in your own currency and the banks will perform the necessary currency conversion.
Confirmation of your payment will be displayed on screen once it has been authorised and accepted. You will also receive confirmation of the transaction to the email address you have provided.
Payments are made electronically through a secure portal using the PayPal system. The secure system is fully compliant with Payment Card Industry Data Security Standard (PCI DSS).
We accept Visa, Mastercard and Maestro credit and debit cards, or payment via your PayPal account. Unfortunately we do not currently accept American Express.
All credit and debit card holders are subject to validation checks and authorisation by the card issuer. If your card is declined we are not liable for any delay or non-delivery and we can suspend any further deliveries to you.
Assuming items are in stock, we will endeavour to dispatch orders within 48hrs of acceptance. However, please allow a maximum of 10 working days of receipt of the order – this allows for busy periods If we are unable to deliver to you within this time scale we will notify you via email.
Our delivery charges are set out in the Delivery & Returns section of our website. We will deliver the goods to the address you specify for delivery in your order, so it’s important that this address is accurate. We use Royal Mail and Parcel Force to deliver packages. Please give us precise instructions for where to leave parcels should you be out when we deliver or you will be notified of where your nearest Post Office is for picking up undelivered parcels. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence).
We will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you.
You will become the owner of the goods you have ordered when they have been delivered to you.
If the goods are lost or damaged in transit, please let us know as soon as possible along with your order number and delivery address.
Cancellation and returns
This policy does not apply to any made to order items.
You can cancel your contract at any time up to 7 working days after the day of delivery. To do this, please email us on firstname.lastname@example.org.
You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future.
If you cancel your contract, you must return the goods to us at your own expense – you are responsible for arranging and paying for the return of the goods to us. We will refund the money you paid for the goods within 30 days of notice from you that you have cancelled your order. You must ensure that the goods are packaged adequately to protect against damage.
If you fail to return cancelled goods, we will collect them, and we will charge you the direct cost of collection. If you fail to take reasonable care of the goods before they are returned to us, and this results in damage or deterioration, we will charge you for the reduction in value.
This cancellation policy does not affect your legal rights — for example, if goods are faulty or mis-described.
Regardless of the reason for a return, goods must be returned in perfect condition, with all tags attached and in, or with, their original packaging. Please quote your order number on all correspondence.
If the goods we deliver to you are not what you ordered or are damaged or defective in any way, please let us know as soon as you can. We will then either (at your request) refund you the amount paid for the goods, or replace the goods you received with goods the ones you ordered. You will be re-credited for the costs incurred in returning faulty or unsatisfactory goods.
Where we are unable to supply replacement goods for any reason, we will issue you with a refund as soon as possible or at the latest within 30 days of your order, by crediting the card with which you paid for your order.

If you return an item for any other reason, it must be returned within 14 days of receipt (seven days on sales items and items in the Clearance section). We will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you that you were entitled to a refund. You will be responsible for the cost of returning the item to us and we will not refund our delivery charges.
We strongly advise that you obtain a free proof of postage from the Post Office which will serve as your security in case your parcel gets lost in the post. Nipper Skipper Ltd cannot be held liable for returned parcels which are lost or damaged in the post.
We will usually refund any money received from you using the same method originally used by you to pay for your purchase.
If you wish to exchange an item, please contact us on email@example.com to ensure we have the item you want in stock. Postage and packing is not charged again on exchange orders.
Nipper Skipper Ltd warrant to you that any item purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied.
Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the items you purchased and any losses which are a foreseeable consequence of us breaking the agreement.
This does not include or limit in any way our liability for death or personal injury caused by our negligence, under section 2(3) of the Consumer Protection Act 1987, for fraud or fraudulent misrepresentation, or for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

Damage to your computer
We try to ensure that this website is free from viruses or defects through regular updates. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.
Law and Jurisdiction
These online terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided by the Courts of England and Wales. All contracts are concluded in English.
